1. Provider and Acceptance
These Terms of Service govern your use of WhatsReal, including the public website, iOS app, iOS share and action extensions, and related backend APIs operated by Manuel Thurner. By accessing or using the service, you agree to these terms.
2. Service Description
WhatsReal enables users to submit images and videos for automated assessment designed to estimate whether content may have been generated, altered, or manipulated using AI. The service may also provide explanatory findings, referral features, account deletion tools, and premium functionality.
3. Eligibility
You must be at least 16 years old to use the service independently. If the law in your country requires parental or guardian consent for a person of your age, you may use the service only with that consent. You may not use the service if your use would violate applicable law, export restrictions, platform rules, or third-party rights.
4. Authentication and Accounts
The audited service does not provide a standalone username/password registration flow. App access is tied to authentication through Supabase using Sign in with Apple or Google, and premium access is tied to the authenticated user account and applicable subscription status. You are responsible for access to your device, Apple ID, Google account, and any associated authentication credentials.
5. Paid Features and Purchases
Certain features may require an active paid subscription. Purchases, renewals, billing, and refunds are handled through Apple’s App Store ecosystem and supporting purchase infrastructure, including RevenueCat. We may suspend premium access if subscription status cannot be verified or if payment-related abuse is suspected.
6. Your Content and Rights You Grant
You retain ownership of the media and other content you lawfully submit. You grant us a limited, non-exclusive, non-transferable license for the duration necessary to host, reproduce, process, transmit, store, and display that content solely to provide the service, improve operational reliability, detect abuse, resolve support issues, and comply with legal obligations.
You represent and warrant that you have all rights, permissions, and lawful bases needed to submit the content and to allow us and our processors to handle it for the above purposes.
7. Prohibited Uses
You may not:
- upload unlawful, infringing, defamatory, exploitative, or abusive content;
- submit personal data or sensitive material of third parties where you lack a valid legal basis to do so;
- use the service to create, support, or facilitate harassment, fraud, surveillance abuse, or unlawful profiling;
- probe, disrupt, overload, reverse engineer, scrape, or bypass technical or contractual restrictions;
- circumvent quotas, paywalls, referral rules, or rate limits;
- use automated access methods except where expressly authorized by us in writing; or
- present a WhatsReal output as definitive proof, certification, expert evidence, or legal advice.
8. AI Output Disclaimer
WhatsReal relies on automated models and third-party processors. Results are probabilistic and may be false, incomplete, delayed, or inconclusive. The service does not verify the truth of an event, the identity of a person, the authorship of content, ownership rights, or the legality of any act. You remain solely responsible for decisions made on the basis of any output.
9. API and Technical Access
The backend APIs are provided as part of the WhatsReal service and are intended for authorized first-party app use unless we expressly agree otherwise. You may not call protected endpoints without valid authorization, attempt to discover hidden endpoints, or use the API in a manner inconsistent with these terms.
10. Availability, Changes, and Beta Risk
We may modify, improve, restrict, or discontinue any feature, provider, pricing model, referral rule, or technical workflow at any time. We do not guarantee uninterrupted availability, permanent storage of submissions, or continued availability of any specific third-party integration.
11. Suspension and Termination
We may suspend, rate-limit, restrict, or terminate access immediately where we reasonably believe that you breached these terms, created security or legal risk, abused referral or premium systems, infringed rights, or where suspension is required by law or processor/platform requirements.
12. Deletion and Survival
You may request deletion through the in-app delete-account feature or by contacting us. Deleting an account does not prevent us from retaining limited information where necessary for legal compliance, fraud prevention, chargeback defense, tax/accounting duties, or claims handling. Clauses that by their nature should survive termination will survive, including clauses on liability, governing law, and prohibited use.
13. Consumer Rights and Mandatory Law
Nothing in these terms limits consumer rights that cannot lawfully be waived under applicable law. If mandatory law gives you additional rights or renders a clause unenforceable, the remainder of these terms will continue in effect.
14. Limitation of Liability
To the fullest extent permitted by law, Manuel Thurner is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunity, goodwill, or data, arising out of or in connection with your use of the service. Nothing in these terms excludes liability that cannot be excluded under mandatory law, including liability for willful misconduct, fraud, or death or personal injury where such exclusion is prohibited.
15. Indemnity
To the extent permitted by law, you will indemnify and hold us harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful content, your breach of these terms, or your misuse of the service.
16. Governing Law and Jurisdiction
These terms are governed by the laws of Italy, excluding its conflict-of-law rules. Mandatory consumer-protection laws of your country of residence remain unaffected where they apply. Unless mandatory law provides otherwise, the courts with jurisdiction over Weinstraße 6, 39057 Girlan BZ, Italy shall have exclusive jurisdiction.

18. Changes to These Terms
We may update these terms from time to time. The current version is the one published on this page. If a change materially affects your rights, we may provide additional notice where legally required.
